Proceedings in the case

In the procedure for entering an invitation in the register of invitations, only the Inviter is a party to the proceedings.

The authority competent to consider the application in this matter is the voivode competent for the place of residence (in the case of a natural person) or the seat of the Inviter.

Filling in the application in a language other than Polish, completing the application in a way that does not allow to understand the content and omitting the required fields are formal deficiencies, the removal of which the Inviter will be called by the voivode. A request to remove formal deficiencies will also be sent if the Inviter does not sign the application or does not attach the documents required in the procedure. Failure to remove formal deficiencies within a period of not less than 7 days from the date of delivery of the summons will result in leaving the application unexamined.

During the proceedings, if it is necessary to supplement or clarify the evidence in the case held by the authority during the proceedings, the inviter may be invited to provide other documents confirming the circumstances referred to in the application. • As of November 10, 2022, the procedure for entering an invitation into the invitation register is a simplified procedure, regulated by the provisions of Chapter 14 Section II of the Law of June 14, 1960. - Code of Administrative Procedure (Journal of Laws of 2022, item 2000). The effect of this is i.a. that the evidentiary proceedings are limited to the evidence submitted by the inviter, including the request to initiate the proceedings (the application to enter the invitation in the invitation register), and the evidence that can be determined on the basis of data available to the authority conducting the proceedings (e.g. data provided in the application).
