Documents

An inviter applying for entry of an invitation in the register of invitations shall submit to the authority:

1. Completed application form for entering the invitation in the register of invitations

The rules for completing the application are presented in the stage: Filling in the application.

2. Documents confirming the possibility of covering the costs related to the foreigner's stay in Poland, including the costs of accommodation and food, as well as the costs of return journey to the country of origin or residence or the costs of transit to a third country that will grant an entry permit.

In terms of the costs of the return journey, it is possible to present a personal return ticket, purchased for the foreigner, to the country of origin or residence of the foreigner – then the costs of return are not included in the settlement.

3. A document confirming the legal title to a dwelling*** or a document confirming the possibility of providing the foreigner with accommodation in another place.

The inviter may present m.in:

  • the deed of ownership of the premises or a current extract from the register of land and mortgage registers, with the proviso that the ownership deed, which concerns only the plot, must be attached together with the confirmation of the building's commissioning or a decision on the assessment of real estate tax.

  • an agreement on the establishment of a cooperative right to the premises or a certificate from the housing cooperative on the allocation of cooperative premises

  • lease agreement for communal premises

  • a lease agreement for premises other than communal, with the proviso that such an agreement must be delivered together with the legal title of the landlord to this premises or their written consent to the foreigner's residence in the premises. If the contract contains a provision on persons entitled to live in the premises, without indicating the invited foreigner, then it is necessary to attach an annex amending this agreement.

  • documents confirming the possibility of providing the foreigner with residence in another place, for example: hotel reservation (The person making the reservation for the invited should be the inviter. The reservation should contain information about who made it, for whom, for what period and for what amount. In the case of a hotel reservation, financial means must be additionally provided to cover the costs of the foreigner's stay in the hotel, as part of the reservation made.)

Attention!

  • The lack of any of the above-mentioned documents (1-3) will result in the foreigner being called upon to complete it within a period of not less than 7 days from the delivery of the summons under pain of leaving the application unexamined.

In addition to the necessary documents (1-3), the following must also be attached:

  • confirmation of payment of stamp duty for entering the invitation in the register of invitations – in the amount of PLN 27.

  • power of attorney with confirmation of payment of stamp duty – in the case of appointing a representative in the proceedings. The stamp duty for each power of attorney is PLN 17.

Remember!

  • the documents should be attached in the original or in a copy certified to be a true copy of the original by a notary public or the party's attorney who is an attorney-at-law or legal advisor; certification of the compliance of the copy with the original may also be made by an authorized employee of the voivodeship office in the administration office, upon presentation of the original document

  • documents drawn up in a foreign language must be presented together with a sworn translation into Polish; the register of sworn translators is kept by the Ministry of Justice and is available here.

  • closely related documents should be presented jointly (e.g., a sublease agreement with a lease agreement) and be valid on the date the permit is issued.
