Schengen Information System (SIS) for the purpose of refusing entry

Decision

Head of the Office for Foreigners, in connection with the submitted application for:

• providing information on the inclusion of a foreigner's data in the list or the Schengen Information System for the purposes of refusing entry

• rectification of data

• deletion of data

issues a decision in which it provides information on each time whether currently (as at the date of the decision) the foreigner's data are on the list of foreigners whose stay on the territory of the Republic of Poland is undesirable or in the Schengen Information System for the purposes of refusing entry from a Polish entry (even if in the interest of the foreigner, there is only one of the registers).

Where data are listed and stored in the Schengen Information System for the purpose of refusing entry into the Schengen territory, information shall be provided on the duration of the alert and on the legal and factual basis of the alert.

Refusal to provide information

• The Head of the Office shall refuse to provide a foreigner with information on the basis of the actual entry if the foreigner's data are included in the list or in the Schengen Information System in connection with the circumstances referred to in Article 435(1)(4) – that is, when it is required for reasons of defence or state security or protection of security and public order or the interest of the Republic of Poland.

• The same shall apply in the case of inspection of listing documents. A foreigner has the right to inspect documents regarding the inclusion of their data in the list, but this right is not granted to a foreigner when their data are included in the list in connection with the circumstances referred to in Article 435(1)(4), i.e. when it is required for reasons of defence or state security or protection of security and public order or the interest of the Republic of Poland.
