Document "consent to tolerated stay"

Return

A foreigner is obliged to immediately return the document "consent to tolerated stay" to the authority that issued it when:

  • acquired Polish citizenship;

  • a decision has been issued to cancel that document;

  • a decision was issued to withdraw their consent to tolerated stay;

  • when the decision to grant them a permit for tolerated stay has expired by operation of law on the basis of the provisions of Article 354(1)(1), (3) or (4) or (2) of the Act of 12 December 2013 on Foreigners, i.e., in connection with:

- granted refugee status or subsidiary protection,

- written notification by them to the Border Guard authority of the waiver of the right to use the consent for tolerated stay,

- obtaining a permanent residence permit from him,

- granting them permission to stay for humanitarian reasons.

The document must be returned immediately, but no later than within 14 days from the date on which:

  • he was served with a document confirming the acquisition of Polish citizenship,

  • the decision to declare this document cancelled or the decision to withdraw the foreigner's consent to tolerated stay has become final,

  • the decision to grant a foreigner permission for tolerated stay expired by operation of law on the basis of the provisions of Article 354(1)(1), (3) or (4) or (2) of the Act of 12 December 2013 on Foreigners.

Note: at the request of the holder of the document who returned it, the authority to which the document was returned shall issue a certificate of return free of charge, valid for a period of 30 days.
