The exchange of the document "consent to tolerated stay” takes place in the case of:

• changes to the data contained in the document,

• damage to the document,

• loss of the document,

• changes in the facial image of the holder of the document in relation to the facial image placed in the document to an extent that makes it difficult or impossible to identify the holder.

The document "consent to tolerated stay" is mentioned by the commander of the Border Guard branch or the commander of the Border Guard post competent for the place of stay of the foreigner.

If the decision to grant the document "consent to tolerated stay” was issued by the Head of the Office for Foreigners (in appeal proceedings), this document is issued by the commander of the Border Guard branch or the commander of the Border Guard post, who ruled on this matter in the first instance.
