Performing work during the procedure for applying for a residence permit

Introduction

If a foreigner has applied for a residence permit, i.e., a temporary / permanent / long-term EU resident permit, in advance until the expiry of the validity of the document entitling them to stay in Poland (e.g., visa) or until the end of the period of allowed stay in visa-free regime, they may perform work on the same terms as before submitting the application.

A foreigner may continue their stay in Poland if they submitted an application for a residence permit at the latest on the last day of legal residence, and the application did not contain formal deficiencies or completed these deficiencies within the deadline (more about formal deficiencies – here) – their stay is then considered legal, until the date of issuing a final decision on this application (which also assumes the possibility of staying during the appeal proceedings, if such is the case). In such a situation, the voivode is obliged to include a special stamp in the foreigner's passport.

While waiting for the application to be considered, the foreigner – as long as they are "only in the procedure" – may perform work in strictly defined cases, approximated in the stage "Detailed explanation".
