Extension of the period of authorised stay in visa-free travel

Article 20(2) of the Convention implementing the Schengen Agreement of 14 June 1985 between the Governments of the States of the Benelux Economic Union, the Federal Republic of Germany, and the French Republic on the gradual abolition of checks at their common borders of the Schengen Implementing Convention (Schengen Implementing Convention) states that Member States have the right to allow a foreigner to extend the period of authorised stay beyond 90 days in a period of 180 days:

  • in exceptional circumstances

  • in accordance with a bilateral agreement concluded before the entry into force of the above-mentioned Convention and notified to the European Commission.

The above-mentioned list of international agreements has been published as a list of bilateral agreements on the abolition of visas concluded by Member States with third countries, allowing the extension of the period of stay in accordance with Article 20(2)(b) of the Convention implementing the Schengen Agreement (Journal of Laws EU of 8.4.2019, C130/17).

The provisions of Articles 300-301 of the Act of 12 December 2013 on Foreigners regulate the procedures related to the extension of visa-free stay on the territory of the Republic of Poland.

Bilateral agreements concluded with third countries indicate the period for which visa-free travel can be extended, as well as the categories of travel documents issued by the above-mentioned countries whose holders may apply for an extension of stay.
