Requirements

In order for a foreigner to be able to obtain a residence permit, it is necessary for the foreigner to meet the following requirementsin a combined manner:

  • he is a person entitled to apply for a permanent residence permit they are therefore a third-country national or a stateless person, and at the time of the application they are staying in the territory of Poland on the basis of a short-term residence title (excluding certain grounds of residence);

  • belongs to the category of foreigners to whom a permanent residence permit may be granted (as explained in the Introduction section);

  • both the declared and the actual purpose of their stay on the territory of the Republic of Poland is the intention to settle in Poland;

  • complete the formal requirements related to the permit, including: submit the application in person, on the form, together with the necessary attachments, as well as present a valid travel document (or in justified cases, if the foreigner does not have a travel document and it is not possible to obtain it – another document confirming their identity), give fingerprints (except when it is not physically possible to take fingerprints) and pay stamp duty;

  • if they apply for a permanent residence permit due to being married to a citizen of the Republic of Poland – they remain in a real and duly documented marriage with a Polish citizen, and this relationship is recognized by Polish law;musi therefore be a relationship registered in accordance with the law, non-polygamous, heterosexual, without a purely religious character, of persons with the ability to conclude it;

  • in the case of persons of Polish origin –

    at least one of the parents or grandparents or two great-grandparents was of Polish nationality (the condition is also met if at least one of the parents or grandparents or two great-grandparents of the applicant confirmed their membership in Poland Nation by, in particular, cultivatedPolish traditions and customs) and

    will show their connection with Polishness.

  • in the case of nationals of the United Kingdom of Great Britain and Northern Ireland referred to in Article 10(1)(.b and (d) of the Withdrawal Agreement, who until 31 December 2020 performed work on the territory of the Republic of Poland as a posted worker –

    has a source of stable and regular (i.e. relatively stable and continuity) income sufficient to cover the cost of subsistence for himself and their dependent family members. The amount of income must be higher than PLN 776 per month if the foreigner manages independently and does not have dependents or exceed PLN 600 per month for each family member. The requirement is also considered to be fulfilled if the costs of maintaining the foreigner will be covered by a family member obliged to maintain him, who resides in Poland;

    has health insurance within the meaning of the Act of 27 August 2004 on health care services financed from public funds or confirmation of coverage by the insurer of the costs of treatment on the territory of the Republic of Poland;

    the required minimum 5-year uninterrupted stay means in this case that the breaks in the stay of a UK citizen did not exceed a total of 6 months per year, unless the break was caused and thus justified:

- compulsory military service, or

- an important personal situation requiring the presenceof a foreigner outside the territory of theRepublic of Poland (related in particular to pregnancy, childbirth, illness, studies, vocational training, secondment) and lasted no longer than 12 months.

Remember!

The periods of residence required on the basis of refugee status granted or subsidiary protection granted include the period of their stay in that territory during the international protection procedure, even if the foreigner was in a guarded centre or in detention for foreigners during that period.
