Regulations

Thepermanent residence permit has been establishedin the provisions of Chapter 1 of Chapter VI. Act of 12 December 2013 on Foreigners (i.e. Journal of Laws of 2021, item 2354, późn.zm. ). The substantive requirements for its granting are laid down in Article 195(1) of that law.

The Act on granting a permit refers to:

  • Act of 9 November 2000 on repatriation(i.e. Journal of Laws of 2019). item 1472) – on the determination of Polish origin (Article5(1) and Article 6(1) and (2));

  • Act of 14 July 2006 on entry into, stay and exit from the territory of the Republic of Poland of citizens of the Member States of the European Union and their family members (i.e. Journal of Laws of 2019, item 293 of późn.zm; Article 47).

The Act also contains a reference to implementing acts regulating the relevant issues concerning the granting of this authorisation, in particular to:

  • Regulation and the Minister of Internal Affairs of 28 April 2014 on the application for granting a permanent residence permit to a foreigner (Journal of Laws of 2014, item 568);

  • Regulation of the Council of Ministers of 11 July 2018 on verified income criteria and amounts of cash benefits from social assistance (Journal of Laws of 2018, item 1358);

  • Regulation of the Minister of Internal Affairs of 26 July 2022 on fees collected in the Republic of Poland from foreigners for issuing and exchanging documents that may be issued to foreigners and the procedure for their payment (Journal of Laws of 2022, item 1583).
