Submission of the application
The Act on Foreigners provides for an obligation for a foreigner to personally submit an application for granting a temporary residence permit – under pain of leaving the application unprocessed.
This obligation should be fulfilled – at the latest on the last day of the foreigner’s legal stay in the territory of Poland (in the case of this particular permit, it is required that immediately before applying for this permit the foreigner was residing on the territory of the Republic of Poland on the basis of a national visa issued for the purposes referred to in Article 60(1)(23) of the Act on Foreigners). Failure to comply with this deadline will result in a refusal to grant the permit (if such proceedings are initiated).
The application filled in at the CHM, after it has been printed and signed, is submitted, together with the attachments, to the Voivode competent for the foreigner's place of residence by prior appointment at the department competent for foreigners at the Voivodeship Office or its delegation. When submitting the application, the foreigner shall give fingerprints, present a valid travel document and attach the necessary documents (additional information are available in the tab: “Documents”).
If the application has been submitted during the legal stay and does not contain formal defects or if they have been corrected in time, the Voivode includes a stamp in the foreigner’s travel document which confirms the submission of the application. The foreigner’s stay is considered legal from the date of submission of the application until the date on which the decision on the granting of the temporary residence permit becomes final.

The departments responsible for foreigners in the provincial offices have adopted a system of electronic appointments for applications. Be sure to check the rules for booking an appointment at a particular office. Waiting times may be extended, so do not delay and book your appointment well in advance.
In a situation where it is not possible to make a visit during your legal stay in Poland, you may send your application in a paper form by post (the date of posting in the post office of Poczta Polska S.A. is decisive) or electronically by ePUAP or you may submit your application at the office (in person or with the assistance of another person). However, you will then be summoned to appear in person on a date set by the Voivode. If you do not comply with the request will be left unprocessed.
