a. Documents required at the application stage

A foreigner applying for a temporary residence permit due to other circumstances referred to in Article 186(1)(9) of the Act on Foreigners, submits the following documents to the Voivode competent for the place of his or her residence:

  • completed as instructed, application form for a temporary residence permit temporary residence – under pain of leaving the application unprocessed. The rules for completing the application are outlined in the next step: “Completing the application.”

  • a photocopy of a valid travel document (at the same time provide the person accepting the application with the original for inspection – otherwise the application will not be processed);

b. Other documents

At the application stage, it is also desirable to submit documents necessary to confirm the data contained in the application and circumstances justifying application for a temporary residence permit. This evidence is not subject to the rigour of leaving the application unprocessed and may be supplemented in the course of the proceedings, but the time limit for dealing with the case depends on the date on which it is submitted. If the application is not accompanied by the required documents, the Voivode calls for them to be produced within a specified period of no less than 14 days.

Including full documentation already at the application stage is in the interest of the party. It tidies up and simplifies the proceedings, as the authority can already at the initial stage make correct findings regarding the foreigner’s situation, which undoubtedly accelerates the process of examining the application and eliminates the risks related to the need for the foreigner to supplement the documentation in the further course of the proceedings for granting a temporary residence permit.

The evidence to be presented in the proceedings includes:

  • documents confirming the intention to stay in Poland for a period longer than 3 months (e.g. a contract of employment, a certificate from a university) or a statement confirming such intention.

Remember!

  • the documents should be enclosed in the original or a copy certified as a true copy of the original by a notary public or a party's attorney who is a legal counsel or attorney-at-law; certification of conformity of a copy with the original may also be performed by an authorised employee of the Voivodeship Office at the registry office upon presentation of the original document;

  • documents which have been drawn up in a foreign language must be submitted together with a sworn translation into Polish; the register of sworn translators is kept by the Ministry of Justice and is available here.
