Requirements
In order for a citizen of the United Kingdom – the beneficiary of the withdrawal agreement to be able to confirm the right of residence for a period longer than 3 months and register their stay in Poland, it is necessary for them to meet the following requirements in combined manner:
had the right to reside in Poland in accordance with EU law, i.e., in accordance with the conditions provided for EU citizens and their family members, before the end of the transition period (i.e., before 01.01.2021, which also applies to British citizens who entered Poland after the date of Brexit and before the end of the transition period). Check what conditions should be met;
continues the stay in Poland, which began before January 1, 2021, and continues uninterruptedly to the present, with the proviso that uninterrupted stay does not mean the absence of any departures from Poland (as explained below);
stay in Poland does not last longer than 5 years (because a longer stay then qualifies as permanent residence; in such a situation, apply for a document confirming the right of permanent residence);
complete the formal requirements related to the registration of stay, including: submits the application in person (the requirement does not apply to a minor who has not reached the age of 6 by the date of submitting the application, in particularly justified cases, including due to the applicant's state of health, the requirement of personal appearance may be waived),on the form, together with the necessary attachments, and also present a valid travel document or other document proving their identity and nationality.
