Schengen Information System (SIS) for the purpose of refusing entry

Introduction

The Schengen Information System for the purpose of refusing entry to the Schengen territory (SIS) is a collection of registers, a database in which categories of data of persons and objects requested and entered into the system by Member States are processed under the law.

One of the categories processed is the entry of data for the purpose of refusing entry to the Schengen territory. A foreigner whose data are in the Schengen Information System for the purposes of refusing entry shall be refused entry into the territory of the Schengen Area States.

Polish entries in SIS

In accordance with the competences granted by the Act on Foreigners, the Head of the Office for Foreigners is the authority responsible for making Polish entries in the Schengen Information System for the purposes of refusing entry to the Schengen territory.

The data placed from the Polish entry in the Schengen Information System for the purposes of refusing entry to the Schengen territory are the following data:

• a third-country national (from outside the EU) - in connection with the circumstances specified in the Act on Foreigners

• a third-country citizen who is a family member of an EU citizen / NO / IS / LI / CH / UK - the beneficiary of the withdrawal agreement, in connection with the circumstances specified in the Act on entry, stay and exit from the territory of the Republic of Poland of EU citizens and their family members.

The Central Technical Body of the KSI Police Headquarters, in the scope of using data through the National Information System, is the data administrator within the meaning of Article 7 point 4 of the Act of 29 August 1997 on the protection of personal data.

Alerts in the Schengen Information System of other Member States

In accordance with the applicable regulations, the Police Headquarters - Central Technical Body of the KSI is competent to consider a request for information on entering the Schengen Information System for the purposes of refusing entry to the Schengen territory by other Member States.
