Restoration of the deadline for filling formal deficiencies

Introduction

If the application contains formal deficiencies (see: Formal deficiencies), the administrative body is obliged to call on the applicant to complete them within a specified period. It is important, however, that, according to the established jurisprudence of administrative courts, the time limit for removing formal defects in the application indicated in the summons (i.e., the period not shorter than 7 days from the date of delivering the summons) is an instructional term. This means that its expiry does not deprive the administrative authority of the opportunity to consider the case. Consequently, it is not permissible to reinstate the deadline for filling in the formal deficiencies of the application.
