Filling in the application

The application form for a temporary residence permit (to perform work as part of an intra-corporate transfer) is available for download in the Case Handling Module – click to go to the forms.

It has also been made available electronically on the websites of departments competent in matters of foreigners in voivodeship offices, and its paper versions can be obtained at the headquarters of these departments, their delegations and in other places where it is possible to submit an application (based on the decision of voivodes).

  • The application shall be completed and signed by an authorised person acting in the name and on behalf of the receiving entity.

  • Before completing the application, please read the instruction on page 16 of the application form. You should also read the regulations and procedure explained in MOS or use other sources of reliable information. In the case of incomprehensible issues, it is necessary to seek clarification of them.

  • The application questionnaire should be completed in Polish, legibly, in capital letters entered in appropriate boxes using an indelible pen or pen with black or blue ink.

  • All required fields must be completed.

  • The application must be completed with information and data in accordance with the facts. Therefore, it is necessary to provide m.in. indicate the actual place of future accommodation of the foreigner in Poland. The information and data should be up to date on the date of the request to the authority.

  • The application should be addressed to the voivode competent for the seat of the receiving entity in which the work will be performed.

Detailed rules for completing the application

  • In Part A of the application, on page 1 of the questionnaire, tick the field "to perform work under an intra-corporate transfer" and enter:

personal data of the foreigner (their record should be consistent with the transcription made in their travel document.),

their date and place of birth (in Polish notation, e.g., not Kyiv but Kijów)

nationality or a note of non-nationality (absence or stateless).

in point 10, specify its "gender" – enter K- in the case of a woman or M- in the case of a man.

under the heading 'marital status' the following shall be entered: maiden, bachelor, married, divorced, widow or widower, according to the marital status of the foreigner.

  • in part B I. the current address of the foreigner's stay outside the territory of the Republic of Poland (in transcription into Polish) or on the territory of the Republic of Poland (in the case of applying for another permit) should be provided, and in part B. II. the address of the place of declared accommodation in Poland.

  • In part C. II. point a: "Previous stays on the territory of the Republic of Poland", information on previous stays of the foreigner on the territory of the Republic of Poland should be provided in accordance with the travel document held, entering in the YEAR-MONTH-DAY format, the date of each entry and exit from the Republic of Poland. If the travel document does not map all border crossings (no border check stamp), and the foreigner does not remember the exact date of entry and exit from the Republic of Poland it is necessary to provide approximate periods of stay in Poland, e.g., if the entry took place on 2019-06-19 and the departure on 2019-07-15 indicate "from about mid-June to about mid-July 2019." or "June – July 2019". If the foreigner is not able to provide even months of stay, try to provide the most precise information possible, e.g. "I stayed during the holiday period for several weeks of 2019", "I stayed at the turn of 2019 and 2020 for about 3 months", etc. If the foreigner has not previously stayed in Poland (for the first time they will enter the Republic of Poland) – enter "none" in the field. If their current stay is the first, the date of entry (from) should be given, and it should be stated that the foreigner is staying in Poland to date.

Due diligence must be exercised when completing the application. This means that some efforts should be made to determine the periods of stay in Poland (e.g., on the basis of hotel reservations, on the basis of airline tickets, etc.).

As regards the basis of residence, it should be indicated on what basis each foreigner stayed in Poland.

The same should be done by completing the application in the section on previous stays in the EU.

  • points I and II of Part D shall be completed if the foreigner is to carry out intra-corporate transfer work as a manager or specialist. In Part D, points II and III shall be completed if the foreigner is to perform intra-corporate transfer work as a trainee worker.

  • These appendices to the application shall correspond to the actual annex. The application must be accompanied by documents, as explained in the "Documents" section.
