Right of permanent residence of a citizen of the United Kingdom – the beneficiary of the withdrawal agreement

On February 1, 2020, the Agreement on the withdrawal of the United Kingdom of Great Britain from the European Union and the European Atomic Energy Community (Journal of Laws EU L 29 of 31.01.2020, p. 7), on the basis of which Great Britain left the structures of the European Union (the so-called Brexit) came into force.

The application by Poland of this agreement with regard to the residence rights of British citizens and their family members is ensured in:

  • the Act of 14 July 2006 on the entry into, stay and departure from the territory of the Republic of Poland of citizens of the European Union Member States and their family members (i.e. Journal of Laws of 2019, item 293, as amended)

- and executive acts to this act, i.e.:

  • Regulation of the Minister of the Interior and Administration of December 29, 2020 on a certificate confirming the submission of certain applications by citizens of Great Britain and Northern Ireland and their family members (Journal of Laws of 2020, item 2457)

  • Regulation of the Minister of Interior and Administration of December 31, 2020 on applications and documents regarding the right of residence on the territory of the Republic of Poland of citizens of Great Britain and Northern Ireland and their family members (Journal of Laws of 2020, item 2450).

The requirements for the acquisition by a citizen of the United Kingdom of the right of permanent residence in Poland and the procedure for obtaining a document confirming this right are regulated in the Regulations of Chapters 4 and 4a of the said ActRight of permanent residence.
