Inadmissibility of the appeal

Introduction

The appeal body, after receiving an appeal against the administrative decision from the first-instance body, first assesses whether the formal requirements of the appeal have been met (see: formal deficiencies) before considering it on its merits, and then whether the appeal is admissible.

The inadmissibility of an appeal is the statement that it cannot produce legal effects.
