Regulations

A temporary residence permit for the purpose of studying is regulated in the Regulations of Chapter 6. Section V of the Act of 12 December 2013 on Foreigners (i.e., Journal of Laws of 2021, item 2354 of.)

The substantive requirements for its granting are set out in Article 144(1) of the said Act.

The Regulations on the granting of a temporary residence permit for the purpose of studying are applied in conjunction with the regulations on the granting of all types of temporary residence permits adopted in Chapter 1 of Section V: General Part.

The Act also contains a reference to implementing acts regulating the relevant issues concerning the granting of this permit, in particular to:

  • Regulation of the Minister of the Interior and Administration of April 17, 2019 on the application for granting a temporary residence permit to a foreigner (Journal of Laws of 2019, item 779);

  • Regulation of the Minister of Internal Affairs and Administration of 6 February 2018 on the number of financial means that a foreigner undertaking or continuing studies on the territory of the Republic of Poland must have (Journal of Laws of 2022, item 78);

  • Regulation of the Minister of Science and Higher Education of 23 September 2019 on the model certificate of the unit conducting studies or education at a doctoral school on the admission of a foreigner to full-time studies or education at a doctoral school or on the continuation of full-time studies or education at a doctoral school (Journal of Laws of 2019, item 1847);

  • Regulation of the Council of Ministers of 24 September 2020 on determining the countries whose citizens taking a preparatory course to study at university are granted a temporary residence permit for the purpose of studying at university (Journal of Laws of 2020, item 1690);
