Introduction

A temporary residence permit due to other circumstances is a type of temporary residence permit, i.e., a permit entitling to stay in Poland temporarily for a specific purpose, granted to third-country nationals (i.e., persons who do not have citizenship of one of the EU countries, Norway, Iceland, Liechtenstein or Switzerland) and stateless persons, regardless of their age, if the main purpose of their stay in Poland is intention to undertake or continue the education received m.in.:

  • in primary school

  • in secondary school, including post-secondary school

  • as part of part-time (i.e., part-time) first-cycle, second cycle and long-cycle programmes

  • as part of postgraduate / MBA studies

  • as part of a language course.

The condition for granting the permit is that the education justifies stay in Poland for a period longer than 3 months, and the foreigner has: health insurance and sufficient financial means to cover the costs of education, subsistence in Poland and return to the country of origin or permanent residence. It is also necessary for the foreigner to have a guaranteed place of residence during their stay in Poland.

This permit is granted in the form of an administrative decision by the voivode, competent for the place of residence of the foreigner, and in the case of appeal proceedings – by the Head of the Office for Foreigners, for the period necessary for education, but not longer than for a period of 1 year.

This permit is not automatically renewed – a foreigner interested in continuing their stay in Poland before its expiry should apply for a temporary residence permit, e.g., another temporary residence permits due to other circumstances, or an indefinite permit, if they meet the requirements necessary to grant it.

Remember!

  • Within the meaning of the migration regulations, the term "studies” means education at a university approved by the minister competent for internal affairs, or in respect of which a decision has not been issued prohibiting the admission of foreigners, unless this unit is subject to the obligation of approval, collected: at full-time I., II. degree or long-cycle studies, or at a doctoral school, in cases strictly defined by law, also as part of the preparatory course for education at these studies. All forms of education at universities other than the above-mentioned ones, such as m.in part-time higher education, postgraduate studies, MBA studies, are referred to as science, not studies.

  • This permit does not entitle you to perform work without the need to have a work permit.

  • The period of study is not included in the stay required for the purpose of obtaining a long-term EU resident's residence permit. A certificate of graduation in Poland (primary, secondary, artistic) with a Polish language of instruction confirms the knowledge of the Polish language required to acquire the status of a resident.
