Change of permit

A foreigner staying in Poland on the basis of a temporary residence permit in order to perform work in an occupation requiring high qualifications is obliged to notify in writing the voivod who granted the permit, within 15 working days, of:

  • loss of employment with any of the entities entrusting work (employers) listed in the permit - throughout the period of validity of the permit.

  • a change in the minimum working hours and a change in the type of contract under which he performs work, as specified in the permit - during the first two years of residence under this type of permit (the first or subsequent).

  • change of position, reduction of salary, change of minimum working hours and change of type of contract - after the expiration of 2 years of stay under this type of permit (first or subsequent).

If this permit was granted by the Head of the Office for Foreigners in the second instance, the above-mentioned notification is addressed to the governor who ruled on the granting of this permit in the first instance.

If the above obligation is fulfilled, the Blue Card permit will not be revoked within a period of 3 months counted from the date of loss of work. Such a situation may occur no more than twice during the validity of the permit. The period of unemployment of a foreigner may not exceed 3 months during the validity period of this permit.

This obligation is also considered fulfilled if the foreigner, within 15 working days, submits an application to the provincial governor for a change of the temporary residence permit for the purpose of performing work in a highly qualified profession (applies to the first two years of residence under the Blue Card permit).

The foreigner should also apply for an amendment to the permit if, during the first two years of residence under this permit:

  • intends to perform work for an entity other than the one specified in the permit;

  • the position specified in the permit has changed;

  • the amount of salary indicated in the permit has been reduced.

Remember!

Not every change that occurs during the first two years of residence under the Blue Card permit makes it necessary to amend the permit - in the case of:

  • change of name or legal form of the entity entrusting the work;

  • takeover of the workplace or part of it by another entity.

- Blue Card permit does not have to be changed. The foreigner also does not need to apply for a new permit in this situation.

After 2 years of Blue Card residence, you do not have to change your permit if you change your employer or other working conditions, but you still have information obligations (i.e., notifying the governor of a change in position, reduction in salary, change in minimum work performance, and change in the type of contract).

A change in the nature of the work performed such that such work can no longer be considered highly skilled is grounds for revoking the permit.
