The category of third-country nationals and stateless persons who can work in Poland without a work permit includes:

  • full-time students and graduates of full-time higher education at a Polish university,

  • graduates of secondary schools, including post-secondary schools, in Poland,

  • citizens of Armenia, Belarus, Georgia, Moldova, the Russian Federation or Ukraine, performing work that is not seasonal work, for a period not longer than 6 months in the next 12 months, if the district labour office before starting work entered a declaration of employment of a foreign national in the register of declarations, and the work is performed on terms specified in this declaration – provided that you have a residence title in Poland entitling you to perform work,

  • foreigners staying in Poland on the basis of a stamp placed in the travel document, which confirms the submission of an application for a temporary, permanent, or long-term resident permit of the European Union, if immediately before submitting the application they were exempt from the obligation to have a work permit,

  • foreigners with a valid Pole's Card and a residence title entitling them to perform work,

  • foreigners with a temporary residence permit granted in connection with marriage with a citizen of the Republic of Poland,

  • foreigners with a temporary residence permit granted in connection with marriage with a foreigner with refugee status, subsidiary protection, permanent residence permit or long-term resident of the European Union, tolerated residence permit or temporary protection granted to them in Poland,

  • foreigners who, as a result of a life situation – such as the death of the spouse of an EU/EEA/CH citizen or a divorce from an EU/EEA/CH citizen – have retained the right to stay on the basis of a temporary residence permit in Poland,

  • beneficiaries of international protection (i.e., granted refugee status or subsidiary protection) or national forms of protection against expulsion (consent: humanitarian or tolerated stay), as well as beneficiaries of temporary protection,

  • persons settled in Poland (having permanent residence permit, long-term EU resident's residence permit – granted in Poland),

  • using Mobility in Poland:

• Student

• short-term scientist

• short-term intra-corporate transfer (ICT) and during the examination of an application for a temporary residence permit as part of an intra-corporate transfer

  • having a temporary residence permit on the territory of the Republic of Poland granted to mobility users and their families,

  • having a temporary residence permit granted for studies, scientific research, for victims of trafficking in human beings, temporary residence permit due to the status of a long-term EU resident in another Member State or special rights for Turkish citizens,

  • entitled to stay and perform work on the territory of an EU/EEA Member State or Switzerland and employed by an employer established in the territory of that country and temporarily delegated as part of the provision of services in Poland,

  • in relation to which international agreements or separate regulations allow the performance of work without the need for a permit,

  • belonging to one of the categories of foreigners exempt from the requirement to obtain a work permit by the Regulation of the Minister of Labour and Social Policy of 21 April 2015 on cases in which entrusting paid activity to a foreigner on the territory of the Republic of Poland is permissible without the need to obtain a work permit (i.e., Journal of Laws). of 2028, item 2273, as amended), which includes foreigners:

conducting training, taking part in professional internships, performing an advisory, supervisory function, or requiring special qualifications and skills in programs implemented within the framework of European Union activities or other international aid programs, also based on loans taken out by the Government of the Republic of Poland;

who are foreign language teachers who perform work in nursery schools, schools, institutions, centres, teacher education institutions or colleges referred to in the regulations on the school education system, or in voluntary Labour Corps;

who are members of the armed forces or civilian personnel who perform work in international military structures located on the territory of the Republic of Poland, or who are foreigners delegated to implement armaments programs implemented on the basis of agreements to which the Republic of Poland is a party;

who are permanent correspondents of foreign mass media, to whom accreditation of the minister competent for foreign affairs has been granted, at the request of the editor-in-chief of a foreign editorial office or agency, but only in the scope of professional journalistic activity performed for that editorial office or agency;

working up to 30 days a calendar year as a scientist or artist

performing work in connection with sporting events of international importance, referred by the relevant international sports organization, or athletes working up to 30 days in a calendar year in connection with sports competitions;

who are clergy, members of religious orders or other persons who perform work in connection with their religious function, in churches and religious associations and national inter-church organizations, whose status is regulated by an international agreement, regulations on the relationship of the State to a church or other religious association, or who act on the basis of entry in the register of churches and other religious associations, their legal persons or organizational units, and who perform work in the exercise of a religious function in other entities, on the basis of a referral by the competent authority of a church or other religious association or its legal person;

participating in cultural or educational exchange programmes, humanitarian or development aid programmes or student holiday work programmes, organised in consultation with the minister responsible for labour;

performing work for Members of the European Parliament in connection with their duties;

delegated to Polish by a foreign employer (if the foreigner retains their permanent residence abroad) for a period not exceeding 3 months in order to:

- perform assembly, maintenance or repair of supplied equipment, structures, machines, or other equipment, if the foreign employer is their manufacturer

- acceptance of ordered devices, machines, structures, or other equipment made by a Polish entrepreneur

- training of employees of Poland employer who is the recipient of devices, structures, machines, or other equipment in the scope of its operation or use

- assembly and disassembly of exhibition stands, care for them, if the exhibitor is a foreign employer who delegates them for this purpose

holding a valid visa issued for humanitarian purposes;

holding a valid visa with the annotation "Poland. Business Harbour” (i.e., a visa issued as part of a government project to support Belarusian citizens in taking up work and relocation to Polish);

practising the profession of doctor or doctorand dentists who have the right to practice their profession on the basis of the principles set out in the Act on the professions of doctor and dentist;

practising as nurses or midwives who have the right to practise their profession on the basis of the principles set out in the Act on the Professions of Nurse and Midwife;

performing the profession of medical rescue ego having the right to practice their profession based on the principles set out in the Act on State Medical Rescue;

employed in the private domestic service of a member of a diplomatic or consular mission.
