Discontinuance of the proceedings

Introduction

The purpose of administrative proceedings is to settle the matter by issuing a decision resolving it, as to its substance, e.g., a decision on sharing a residence permit or refusing to grant it. However, this goal cannot always be achieved (e.g., in the event of the death of a party) – the proceedings are then terminated (i.e., discontinued) and the authority merely states that its further conduct is pointless.

Discontinuance of the proceedings may also be requested by the party on whose application the proceedings were initiated, e.g., in a situation where, during the proceedings, they abandon the intention to continue staying in Poland and applying for a residence permit, and in connection with the planned departure wants to organize and close cases in Poland.

The decision to discontinue the proceedings may be appealed.
